Affiliate Program Terms

1. Acceptance of Terms
By registering for and participating in The Domain of Faith Affiliate Program ("the Program"), you ("Affiliate") agree to be bound by these Affiliate Program Terms ("Affiliate Terms"). If you do not agree to these terms in their entirety, do not register for or participate in the Program.
2. Program Overview
The Program allows approved Affiliates to earn commissions by referring new subscribers to The Domain of Faith ("the Domain") through unique referral links. Commissions are calculated at 50% of the gross subscription payment received by the Domain from a referred subscriber, on both initial and recurring monthly payments, for as long as the referred subscriber remains active and the Affiliate remains in good standing.
3. Commission Structure
- Rate: 50% of gross subscription payment received (before any payment processing fees).
- Duration: Ongoing — credited on each successful monthly payment from a referred subscriber.
- Applicable Tiers: Tuner ($7/mo = $3.50 commission), Resonator ($21/mo = $10.50 commission), Transmitter ($77/mo = $38.50 commission).
- Cookie Window: 90 days from the initial click of the Affiliate's referral link.
- Attribution: Last-click attribution. The most recent Affiliate referral link clicked prior to subscription receives the commission.
4. Payout Terms
- Schedule: Payouts are processed once per calendar month, for commissions earned in the previous month.
- Holding Period: Commissions are held for a minimum of 30 days after the end of the month in which they were earned, to allow for chargebacks, refunds, and payment disputes.
- Example: Commissions earned in January are paid on or after March 1st.
- Minimum Payout: $25.00 USD. Balances below this threshold roll over to the next payout period.
- Method: PayPal only, to the email address provided at registration.
- Responsibility: Affiliate is responsible for ensuring their PayPal email is correct and capable of receiving payments. The Domain is not responsible for lost payments due to incorrect PayPal information.
5. Sole Discretion Over Payouts
The Domain of Faith retains sole and absolute discretion over all commission calculations, payout determinations, and dispute resolutions. All decisions regarding commissions, payouts, and Program participation are final and binding. The Domain may withhold, adjust, or deny any commission at its sole discretion, including but not limited to circumstances involving suspected fraud, violation of these terms, chargebacks, refunds, or payment processor disputes.
6. Prohibited Activities and Grounds for Termination
The following activities are strictly prohibited and constitute grounds for immediate termination from the Program and forfeiture of all earned but unpaid commissions:
- Fraud, deception, or misrepresentation of any kind
- Self-referral (using your own affiliate link to subscribe)
- Use of spam, unsolicited commercial email, or automated posting tools
- Bidding on Domain of Faith trademarks or variations in paid search advertising
- Use of cookie-stuffing, forced clicks, or other unauthorized tracking methods
- Creating sites that impersonate, copy, or falsely represent affiliation with the Domain
- Promoting the Domain through illegal, deceptive, or unethical means
- Making false claims about the Domain's content, effects, or results
- Promoting the Domain on sites containing illegal content, hate speech, or adult material
- Any activity that could reasonably damage the Domain's reputation or brand
7. Consequences of Termination
Upon termination from the Program for any reason:
- Immediate forfeiture: All earned but unpaid commissions are immediately forfeited and will not be paid.
- Future commissions: Affiliate loses all rights to any future commissions, including recurring commissions from previously referred subscribers.
- Referral link deactivation: The Affiliate's referral link will be deactivated and will no longer track referrals.
- Fraud referral to authorities: In cases of suspected fraud, the Domain reserves the right to refer the matter to appropriate legal authorities and pursue all available legal remedies.
8. Modification and Termination of Program
The Domain reserves the right to modify, suspend, or terminate the Program at any time, for any reason, with or without notice. This includes but is not limited to:
- Changing commission rates, payout schedules, or Program rules
- Changing the focus, content, or business model of the Domain website
- Discontinuing the Domain website or any of its services entirely
- Closing the Domain as a business entity
Upon termination of the Program, no further commissions of any kind shall be owed to any Affiliate. Affiliates shall have no claim to future earnings, ongoing commissions, or compensation of any kind following Program termination. The Domain's obligation to pay commissions extends only to commissions already earned and confirmed prior to Program termination, subject to the payout terms in Section 4.
9. Changes to Affiliate Terms
The Domain reserves the right to modify these Affiliate Terms at any time, with or without notice. It is the sole responsibility of the Affiliate to review these terms periodically for changes. Continued participation in the Program following any modification constitutes acceptance of the modified terms. If an Affiliate does not agree to modified terms, their sole remedy is to withdraw from the Program.
10. Relationship of Parties
Affiliates are independent contractors. Nothing in these Affiliate Terms creates an employer-employee relationship, partnership, joint venture, or agency relationship between the Affiliate and the Domain. Affiliates have no authority to bind the Domain to any obligation or make any representations on behalf of the Domain.
11. Tax Responsibility
Affiliates are solely responsible for all taxes arising from commissions earned through the Program. The Domain may issue IRS Form 1099 or equivalent tax documentation for Affiliates earning above applicable thresholds in a calendar year. Affiliates are responsible for providing accurate tax identification information upon request.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE DOMAIN OF FAITH, ITS OPERATORS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM OR RELATED TO THE PROGRAM, INCLUDING BUT NOT LIMITED TO LOST COMMISSIONS, TRACKING ERRORS, PAYMENT DELAYS, OR PROGRAM CHANGES. THE DOMAIN'S MAXIMUM LIABILITY TO ANY AFFILIATE SHALL NOT EXCEED THE TOTAL COMMISSIONS EARNED AND UNPAID TO THAT AFFILIATE IN THE PRECEDING SIX MONTHS.
13. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to the Program or these Affiliate Terms shall be resolved exclusively through binding individual arbitration in Mecklenburg County, North Carolina, in accordance with the rules of the American Arbitration Association.
- Class action waiver: Affiliate expressly waives any right to participate in a class action, class-wide arbitration, or consolidated proceeding against the Domain.
- Governing law: These Affiliate Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
- Venue: Any arbitration or legal proceeding shall take place in Mecklenburg County, North Carolina.
- Costs: Each party shall bear its own costs of arbitration. The prevailing party may be entitled to recover reasonable attorneys' fees and costs as determined by the arbitrator.
- Small claims exception: Either party may bring an individual action in small claims court in Mecklenburg County, North Carolina, in lieu of arbitration.
14. Severability
If any provision of these Affiliate Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Affiliate Terms, together with the Domain's general Terms of Service and Privacy Policy, constitute the entire agreement between the Affiliate and the Domain regarding the Program, superseding any prior agreements or understandings.
16. Acknowledgment
By registering for the Program, Affiliate acknowledges that they have read, understood, and agree to be bound by these Affiliate Terms in their entirety. Affiliate further acknowledges that:
- The Domain may change these terms at any time and it is Affiliate's responsibility to review them
- Commission rates, payout schedules, and Program availability are subject to change or termination at the Domain's sole discretion
- The Domain's decisions regarding all aspects of the Program are final
- Prohibited activities will result in immediate termination and forfeiture of all commissions
- Fraudulent activity will be referred to legal authorities
- Disputes will be resolved through binding arbitration in North Carolina
